Terms of Service of Vintage Wholesale Berlin

1. Introduction

These Terms of Service ("Terms") govern your access to and use of our website located at www.vintage-wholesale-berlin.com (the "Site") and any services or products provided through the Site. By accessing or using the Site, you agree to be bound by these Terms in full.

2. Use of the Site

This Site is primarily intended for business customers, professional resellers, and retailers purchasing vintage clothing on a wholesale basis. If you place an order as a business customer, you confirm that you are acting in the course of trade and have the legal capacity to enter into binding contracts under applicable law.

Where an order is placed by a consumer (a private individual acting outside any trade or profession) within the European Union, applicable EU consumer protection rights, including the statutory right of withdrawal, apply as set out in Section 9 and in our Return & Refund Policy.

3. Registration and Accounts

To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, complete, and up-to-date information and to keep your account details confidential. You are responsible for all activities carried out under your account.

4. Privacy

5. Intellectual Property

All content on the Site, including but not limited to texts, images, graphics, logos, and photographs, is the property of Vintage Wholesale Berlin or is used with permission. Any reproduction, distribution, or use of this content without our prior written consent is strictly prohibited.

6. Products and Services

All products sold are vintage wholesale goods. Due to the nature of vintage clothing, variations in style, size, condition, and brand are inherent and accepted as part of the product. Product descriptions are provided for guidance only and may not be exact in every detail.

7. Orders and Payments

By placing an order through the Site, you commit to paying the full amount displayed at checkout. All payments must be made using the payment methods available on the Site. Orders are considered binding once payment has been successfully completed.

8. Shipping and Deliveries

Shipments are made according to the shipping methods and rates selected during checkout. While we aim to dispatch orders within the stated timeframes, delivery times are estimates only and cannot be guaranteed. Delays caused by carriers or customs are outside our control.

9. Cancellations and Returns

For business-to-business (B2B) orders, Vintage Wholesale Berlin does not accept returns or offer refunds, except where an error has been made by our team (such as incorrect items sent or products not matching the order description). Such claims must be reported in writing within 24 hours of delivery and are subject to review and approval by our team. Approved returns must be shipped back within 14 days of confirmation.

If you are a consumer based in the European Union, you have a statutory right to withdraw from your contract within 14 days, for any reason and without justification. You may exercise this right using the withdrawal function (withdrawal button) available on the Site, or by a clear statement sent to us. After submitting your withdrawal you will receive a confirmation of receipt by email. The 24-hour B2B claim period above does not apply to and does not limit this statutory consumer withdrawal right. Full details, conditions, and exemptions are set out in our Return & Refund Policy, which prevails over the B2B terms for consumer purchases.

10. Limitation of Liability

To the fullest extent permitted by law, Vintage Wholesale Berlin shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Site or the purchase of products through the Site.

11. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Any changes will take effect immediately upon being published on the Site. Continued use of the Site constitutes acceptance of the revised Terms.
